Bank cards

We use the HiPay e-commerce solution, so your data is protected." In fact, your bank information is not processed by our servers since it is securely transmitted directly to our banking partner.

Purchases in 2, 3 or 4 payments with no fees

This service is available if your order is recorded and invoiced in a private individual's name for an amount greater than or equal to 90 euros incl. VAT for 2 payments, 200 euros incl. VAT for 3 payments, and 300 euros incl. VAT for 4 payments (excluding delivery costs)

Payments are due monthly and can be spread out over a maximum period of 90 days if making 4 payments.

You pay no processing fees.

Approval of bank card purchases in 2, 3 or 4 payments is subject to the confirmation of your order by our Departments. You may be asked to provide additional information during the order confirmation process in order to ensure the quality and security of your delivery.

PayPal

You can use your PayPal account to pay for your order.

Cheque

  • Write your cheque in euros to the order of LEPAPE
  • Enclose your cheque, signed and dated with the current day's date, with the order number indicated in the confirmation email written on it.

Your order will be prepared once your cheque is received and approved by our accounting team.

Cheque purchases in 2, 3 or 4 payments

This service is available if your order is recorded and invoiced in a private individual's name for an amount greater than or equal to 90 euros incl. VAT for 2 payments, 200 euros incl. VAT for 3 payments, and 300 euros incl. VAT for 4 payments (excluding processing and delivery costs)

Unilateral changes to the order will not be accepted after your order is shipped and your first cheque is cashed.

Approval of cheque purchases in 2, 3 or 4 payments is subject to the confirmation of your order by our Departments. You must hold a bank account domiciled in France. You may be asked by our departments to provide additional information during the order confirmation process in order to ensure the quality and security of your delivery.

Conditions and procedure for returns

Exchange and Return Policy

The return policy detailed below only applies to private individuals for website purchases of shoes, clothing, accessories and electronic devices (watches," GPS devices, electrical muscle stimulators)."

You have 30 days (from the delivery date) to return ordered items to us. For any exchange request, you must contact the 01 53 75 00 00, which will make sure your product is reserved, and have you follow the information on the return form.

Exchanges

We’ll exchange your items within 5 days (upon receipt of your parcel) provided that the items you wish to exchange are available. To expedite the exchange, you must contact" our Sales Department before returning your items in order to confirm the availability of the models, sizes or shoe sizes requested in exchange.

Shipping of the exchanged items is provided free of charge (by Colissimo).

Refunds

Refunds will be made as soon as possible and no later than 14 days after this right has been exercised, provided we receive the products subject to this cooling-off period in the meantime. Only the amount paid will be refunded, which is the" price of the items purchased plus the outgoing delivery costs (shipping), if applicable."

Return Policy

You are responsible for the return costs unless an error was made while preparing your order or an item is defective, in which case we pay the return costs. Please contact us so we can provide you with a prepaid Colissimo label" (if you are in Metropolitan France). For French Overseas Departments/Territories and outside of France, your refund will be calculated based on shipping by Colissimo Simple without insurance."

Insurance

You are responsible for the return parcels during shipment. We become responsible once they are received at our warehouse.

Gifts

For gift orders, notify our Customer Service Department beforehand indicating the date on which you will likely exchange the item (only an exchange of the item" or a change in size will be possible, and no refunds will be made after 30 days from the delivery date)."

Return Parcels

Items must be returned to us in their original shipping box or an equivalent box (if the original box was damaged). Attention: Item boxes (particularly shoe boxes) are not made for packaging.

Return Items

Electronics

Items must be returned in their original state, unused (empty memory for watches for example), and complete (packaging, accessories, information and instructions, etc.) so that they can be" resold in new condition. Items that come in blister packs or sealed packaging must not be opened or unwrapped under any circumstances or they will not be able to be returned.

Defective Items

Defective items must be sent in their original packaging, complete with all their accessories, information and instructions, etc. A letter must also be included describing the defect.

A defective item will not be subject to a refund; it may only be exchanged for an item of equal value.

According to the provisions of the French Consumer Code (Art. L.121-20 et seq.), the cooling-off period for “remote purchases” is 14 days from the date the product was received by" the customer. Nevertheless, the provisions applicable to cultural products such as map CDs, DVDs, SDs, micro-SDs, etc. are subject to special conditions. In fact, “the cooling-off period" cannot be invoked [...] for vendor contracts [...] for audio or video recordings or software that has been unsealed by the customer.” Therefore," the cooling-off period does not apply to any open CD, DVD, SD or micro-SD map product."


Shoes & Clothing

Items must not have been worn but just tried on (indoors only). Items must be clean, unused, and unworn."

All tags and labels must be present on the items. Items must be in perfect condition and wrapped up properly in their original packaging (plastic packaging around the items to protect them).

Defective Items

Defective items must be sent complete and in their original packaging along with a letter describing the defect.

A defective item will not be subject to a refund; it may only be exchanged for an item of equal value.


Mandatory documents

To help process your return, you must include a copy of the invoice, a letter describing why you are returning the item and the defect found (very important" for electronics), a detailed list of the items in question, and the nature of your request (exchange, refund)."

Bank Card Payments

We will credit your card account. If you purchased your order via multiple payments and are due a partial refund, your refund will be credited back to your account after your final payment due date."

Cheque Payments

1. GENERAL PRINCIPLES
These General Terms of Sale apply to all sales made by Lepape to private individuals for delivery within the territory of Metropolitan France within the limits of available stock. All our sales are subject to French law.
These General Terms of Sale apply to all orders received as from: 15 October 2009.

2. PRODUCT CHARACTERISTICS
The products’ specific characteristics are described as accurately as possible in the product cards on the website.
These products comply the standards in force within French territory.

3. PRECAUTIONS FOR USE
Before using any of the products sold by our company, we urge you to carefully read the instructions and precautions for use, and consult your doctor before making any purchase so as to ensure you possess the physical fitness and training required to engage in the sport or fitness activity in question. If you allow another person to use the product, you are responsible for ensuring that this person possesses the physical fitness required and essential for its use.

4. ORDERS
By placing an order, you agree to these General Terms of Sale, as well as the product prices and descriptions.
Once the order you place on our website is confirmed, you’ll receive an automatic email acknowledging that the order has been received.
However, only an order confirmation originating from contact@lepape.com addresses officially confirms that your order has been accepted. In principle, orders are accepted within 24 hours after your request has been received. The contract of sale is not definitively valid until we receive your payment.

5. PRICES
Invoices are prepared using the price list in effect on the day the sale is concluded, in euros and with the stipulated VAT included. Prices always include the French ecotax, the amount of which is indicated on our website or in our brochure.
Unless otherwise specified, these prices include the delivery charges, the rates and terms for which are indicated on the website.
The rates and terms for delivery are indicated for each product in the technical sheet on the website, in our catalogues, and on our paper purchase orders.

6. PAYMENT
All payment methods are accepted: bank cards, bank cheques, postal money orders, or transfers.
For bank card payments made on our website, the entire transaction is sent encrypted, and thus not directly accessible, to a bank server in SSL (Secure Socket Layer) mode for approval.
The payment terms are indicated on our website. Unless otherwise specified, payment must be made at the time of the order. No discounts are awarded for payments in advance.
Payment is considered to be made when the funds are made available to Lepape.
If a due invoice is not paid, even partially so, Lepape reserves the right to claim, after prior formal notice by registered letter with acknowledgement of receipt (or by equivalent means) remains unheeded for a period of more than 8 days, and without prejudice to any damages or late penalties, calculated based on the amount due, a rate of interest equal to three times the legal tax rate in effect.
For any default on payment, all sums owed our company become due immediately, without any formality, notwithstanding our ability to suspend or cancel the orders being processed at our sole initiative.
The Customer will also have to pay a fixed amount of 45 euros per unpaid invoice to cover the administrative costs for processing the outstanding debt.
To make your shopping easier and stagger your payments, we offer you the possibility of making purchases in 2 payments for orders of €90 and over (incl. VAT), 3 payments for orders of €200 and over (incl. VAT), or 4 payments for orders €300 and over (incl. VAT) (excluding administrative and delivery charges). You can pay by bank card or cheque. You pay NO processing fees for this service, regardless of your order amount.

7. DELIVERY
Stock availability is indicated in real time in the product cards.
Delivery is generally made within 24 hours for orders placed before 15:30 using Chrono Relais and Chronopost. If not, the average delivery time is 48 hours (Metropolitan France except Corsica).
Delivery by Chrono Relais 24 hours or Collissimo 48 hours is free for purchases of €90 and over incl. VAT.
If a product, accessory, or piece of equipment is unavailable, we will do our best to warn the customer of any foreseeable delay in delivery beforehand by mentioning this on our website and in a personal message sent to the email address or postal address indicated while ordering.
If delivery is delayed at least 7 days after the stated time limit, we will give you the option of cancelling your order by email by contacting contact@lepape.com, or by registered letter with acknowledgement of receipt to the following address: 39 rue d’Artois 75008 Paris France (new Article L.121-20-3 of the French Consumer Code).

8. CONFORMITY - ACCEPTANCE
The condition of the ordered products must be verified upon delivery.
When a product is not in accordance with the order, the customer must notify us by registered letter with acknowledgement of receipt within 7 days from the date the product was received if he or she chooses not to use the cooling-off period option.

9. COOLING-OFF PERIOD
During the cooling-off period, you will have the right to return the ordered products or request an exchange for a period of 14 days from the date they were delivered. For returns, the products must not have been used.
This cooling-off period does not apply to business customers (companies, associations, etc.).
They must be returned to us in their complete and original condition (packaging, accessories, information and instructions, etc.) so that they can be resold in new condition. They must also be accompanied by a copy of the invoice to expedite the process.
Likewise, if the product is returned incomplete or damaged, we reserve the right to reduce the amount refunded to the customer proportionately on the basis of verifiable evidence. Otherwise, the products will be refunded under the same conditions as for the original payment.
The customer is responsible for the return costs.
Only the amount paid will be refunded, which is the price of the items purchased plus the outgoing delivery costs (shipping), if applicable. Refunds will be made as soon as possible and no later than 14 days after this right has been exercised, provided we receive the products subject to this cooling-off period.

10. STORAGE OF PRODUCTS BY THE CUSTOMER
We invite you to review the storage instructions appearing in the technical specifications, and on the packaging beforehand.
The customer is solely responsible for any deterioration or damage that may occur to the products, equipment, or accessories due to storing them in improper conditions or in conditions incompatible with the product’s properties.

11. WARRANTY
Our company provides a legal warranty against flaws or hidden defects in products sold, in accordance with Articles 1641 to 1649 of the French Civil Code.
In addition, our customers also benefit from contractual warranties negotiated with the manufacturers of each piece of equipment or accessory.
In accordance with Article L.217-12 of the French Consumer Code, warranty claims due to conformity defects are valid for 2 years from the date the product was delivered.

12. WITHHOLDING OF PRODUCTS
If there is a payment issue concerning any order made to the company, Lepape reserves the right to withhold products not actually delivered to the Customer that have not been paid for.

13. TITLE RETENTION CLAUSE
Title to the products sold shall remain vested in the company until the purchase price has been paid in full.
Payment is understood as paying the price of the products, and any fees associated with the Sale, plus interest.
For any default on payment, the Customer must, at his or her own expense, risk and peril, return the unpaid-for products following a formal request by registered letter with acknowledgement of receipt.
In this case, the Sale will be cancelled by operation of law on the day restitution is requested.
Lepape will withhold any sums paid as indemnification, without prejudice to any other compensation.
The Customer may not under any circumstances pledge products that have not been paid for, provide them as collateral, or grant security interests on them.

14. INTELLECTUAL PROPERTY
All the elements on our website or in our catalogues, whatever their nature, including the underlying technologies, are protected by copyright and trademark law, including drawings, models, and certain patent-protected products that we sell.
No reference to or reuse of any element from our website or our catalogues, in whole or in part, is allowed without our prior express consent, on penalty of being held liable for infringement.

15. PERSONAL DATA PROCESSING
We collect personal information from you that is essential for placing and processing your order. These data are intended exclusively for our company and will not be distributed externally.

16. LIABILITY
As concerns the products we sell, our liability is limited to any direct, foreseeable damages suffered by the customer.
Our company cannot be held liable for any inconvenience and damages incurred from using the Internet, such as disruptions in service, computer viruses, or outside security breaches.
Furthermore, we cannot be held liable in cases of force majeure.

17. LEGAL CLAIMS
Legal claims linked to the conclusion, execution or cancellation of a sale made by a professional from our company shall fall under the jurisdiction of the PARIS Commercial Court, even in the event of summary application to a single judge, or multiple proceedings or parties. This provision is not applicable when a Lepape customer is a consumer as defined in the French Consumer Code.

18. MEDIATION
In that event that a dispute arises between the parties, the customer has the free right to appeal to a consumer mediator in order to amicably resolve the dispute with Lepape. In this regard, Lepape guarantees the customer access to a consumer mediation process.

· the customer cannot establish having attempted to resolve the dispute beforehand with Lepape by sending a written claim by registered letter with acknowledgement of receipt to Lepape within fifteen (15) days from the date the product was delivered;

· the claim is clearly unfounded or abusive;

· the dispute has been previously examined or is currently being examined by another mediator or a court of law;

· the customer presented the claim to the consumer mediator more than one (1) year after sending the written claim to Lepape;

· the claim does not fall within the mediator’s expertise.
